myCicliva Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Cuspart (“Cuspart,” “we,” “us,” or “our”) governing your use of the myCicliva application and related features (the “App”).

By downloading, accessing, or using the App, you agree to these Terms.

1. What myCicliva provides

myCicliva is a personal cycle, wellbeing, and health-journaling application.

The App may help you record information locally, view cycle and wellness summaries, review patterns and estimates, use reminders and widgets, use optional Apple Health integration, use optional Partner Sharing, and access myCicliva+ subscription features.

The App is not a medical device, healthcare provider, diagnostic service, treatment service, or substitute for professional medical advice.

All estimates, scores, summaries, reminders, predictions, and insights are informational only. Do not use the App for emergencies or to make a medical decision without consulting a qualified healthcare professional.

2. Local information and privacy

Most information created in the App remains on your device and local App storage.

Cuspart does not operate a user account or health-data collection server for myCicliva and does not collect your personal or health entries for its own database.

The App does not contain third-party advertising or analytics SDKs.

The App’s data practices are described in the Privacy Policy.

3. Apple Health

Apple Health integration is optional and requires your permission.

If enabled, myCicliva may read selected HealthKit information and may write selected menstrual-flow information to Apple Health.

HealthKit permissions are controlled by Apple and can be changed through Apple Health or device settings.

4. Partner Sharing

Partner Sharing is optional and disabled unless you enable it.

When enabled, the App sends a limited rhythm summary to Apple CloudKit so that another person using your sharing code can retrieve it.

The basic summary may include your display name, cycle context, cycle-day information, next-period information, period-start information, log count, and update date.

You may also choose additional supported rhythm fields such as phase, period timing, fertility status, peak-fertility estimate, pregnancy week, postpartum day, and a general rhythm summary.

Raw notes, symptoms, detailed medication information, mood details, sexual-activity details, doctor reports, exported files, and full health logs are not included in the partner summary.

You are responsible for keeping your sharing code secure. Anyone with the code may be able to retrieve the active summary.

You can stop Partner Sharing in the App. Stopping sharing deactivates the shared record for future retrieval. Apple may retain technical records according to its CloudKit terms and policies.

5. myCicliva+ subscriptions

The App may offer an auto-renewable myCicliva+ subscription.

Available plans, prices, billing periods, and introductory offers are shown in the App and may vary by region.

– Payment is charged to your Apple Account when you confirm the purchase.
– Unless cancelled, the subscription renews automatically at the end of the current period.
– Your Apple Account may be charged for renewal within 24 hours before the current period ends.
– You can manage or cancel the subscription in your Apple Account subscription settings.
– Cancelling stops future renewals but normally does not refund the current subscription period.
– Refund requests are handled by Apple according to Apple’s applicable policies.
– Any free trial or introductory offer is subject to the terms shown by Apple and the App Store.
– Purchases can be restored through the App’s restore-purchase feature.

Cuspart may change subscription features or pricing as permitted by applicable law and App Store rules.

6. Your responsibilities

You agree to:

– use the App only for lawful purposes;
– keep your device and Apple Account secure;
– protect any Partner Sharing code;
– review estimates and reminders before relying on them;
– avoid using the App as a replacement for professional medical care; and
– avoid using the App for emergency decisions.

7. Intellectual property

The App, its design, software, names, trademarks, text, graphics, and other content are owned by or licensed to Cuspart and are protected by applicable intellectual-property laws.

You may not copy, distribute, sell, sublicense, lease, modify, or create derivative works from the App except as permitted by law.

8. Third-party Apple services

The App uses Apple services and frameworks including StoreKit, Apple Health, HealthKit, iCloud, and CloudKit.

Your use of those services may also be subject to Apple’s terms, policies, and privacy practices.

9. Disclaimer

To the maximum extent permitted by law, the App is provided for personal informational use and without warranties regarding uninterrupted availability, accuracy, completeness, or suitability for a particular purpose.

Cycle, fertility, pregnancy, postpartum, wellness, and health-related estimates may be inaccurate or incomplete.

10. Limitation of liability

To the maximum extent permitted by law, Cuspart will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

Nothing in these Terms excludes liability that cannot legally be excluded.

11. Changes to these Terms

We may update these Terms when the App or its services change. The “Last updated” date will show when changes were made.

Your continued use of the App after an update means you accept the revised Terms to the extent permitted by law.
