These Terms of Use govern your use of Cuspart: GPS (“the App”), operated by Cuspart.
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree with these Terms, do not use the App.
1. USE OF THE APPLICATION
Cuspart: GPS is a speedometer, GPS tracking, route recording, gauge customization, and driving measurement application.
You may use the App only for lawful purposes and in accordance with these Terms.
You must not:
– Use the App while operating a vehicle in an unsafe manner
– Interact with the App in a way that distracts you while driving
– Use the App to violate traffic laws
– Use the App to support dangerous, illegal, or reckless driving
– Reverse engineer, modify, copy, or redistribute the App
– Attempt to bypass subscription or feature restrictions
– Interfere with the operation or security of the App
2. DRIVING SAFETY
Your safety is your responsibility.
Do not operate or interact with your phone while driving. Always obey traffic laws and use the App only when it is safe and legal to do so.
Cuspart: GPS is not a replacement for your vehicle’s certified speedometer, navigation system, emergency services, or professional driving equipment.
3. ACCURACY DISCLAIMER
GPS readings, speed measurements, routes, maps, performance data, and estimated results may be inaccurate or unavailable because of:
– Weak or unavailable GPS signals
– Weather or environmental conditions
– Device limitations
– Map data limitations
– Hardware or software errors
– Loss of location permission
– Operating system limitations
The App is provided for informational and entertainment purposes only.
You should not rely on the App for safety-critical decisions, legal compliance, emergency response, professional measurement, or navigation.
4. SUBSCRIPTIONS AND IN-APP PURCHASES
Cuspart: GPS may offer optional paid features through Cuspart: GPS+.
If you purchase a subscription:
– Payment is charged to your Apple ID account at confirmation of purchase.
– Subscriptions may automatically renew unless canceled at least 24 hours before the end of the current subscription period.
– Your Apple ID account may be charged for renewal within 24 hours before the current subscription period ends.
– You can manage or cancel your subscription through your Apple ID account settings.
– Any free trial or introductory offer will automatically convert into a paid subscription unless canceled before the trial ends.
– Prices, subscription periods, and available features are shown before purchase.
– Refund requests are handled by Apple according to Apple’s policies.
Apple manages payment processing, subscription billing, subscription cancellation, and refunds.
5. FREE AND PREMIUM FEATURES
The App may provide certain features for free and reserve additional themes, gauges, fonts, colors, route features, analytics, or customization options for Cuspart: GPS+ subscribers.
We may change, improve, add, or remove features over time, provided that applicable consumer and subscription rights are respected.
6. INTELLECTUAL PROPERTY
The App, including its design, code, graphics, icons, text, gauge designs, animations, trademarks, and other content, is owned by Cuspart or its licensors and is protected by applicable intellectual property laws.
You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices that you own or control.
No ownership rights are transferred to you.
7. LOCAL DATA
The App may create and store GPS records, routes, settings, and performance information locally on your device.
You are responsible for maintaining your device, backups, and locally stored data.
Cuspart is not responsible for data loss caused by device failure, deletion, operating system changes, loss of access to your device, or failure to maintain a backup.
8. THIRD-PARTY SERVICES
The App may rely on Apple services, including the App Store, Core Location, MapKit, and StoreKit.
Your use of those services may also be governed by Apple’s applicable terms and policies.
9. AVAILABILITY AND UPDATES
We may update, suspend, limit, or discontinue parts of the App when reasonably necessary for maintenance, security, legal compliance, or product improvements.
We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or operating system version.
10. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied.
Cuspart does not guarantee the accuracy, reliability, completeness, or availability of GPS readings, maps, speed measurements, routes, or performance results.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Cuspart will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, business, safety, or property arising from your use of or inability to use the App.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
12. TERMINATION
You may stop using the App at any time by deleting it from your device.
We may suspend or terminate access to paid or premium features if you violate these Terms, misuse the App, or if continued operation becomes legally or technically impossible.
13. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The updated Terms will be published on this page with a revised “Last Updated” date.
Your continued use of the App after an update means that you accept the updated Terms.
14. GOVERNING LAW
These Terms are governed by the laws applicable in the jurisdiction where Cuspart is legally established, without limiting any mandatory consumer protection rights available in your country or region.
15. APPLE APP STORE TERMS
If you downloaded the App from Apple’s App Store, Apple is not responsible for the App, its maintenance, support, warranties, or claims relating to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you where applicable.
